Terms of Service

1. Who we are
Kallit OC ("Kallit," "we," "us") is a software service operated by Monson Development, a sole proprietorship owned by Chad Monson, located in Arizona, United States. By creating an account or using Kallit, you agree to these Terms of Service. If you do not agree, do not use the service.
2. The service
Kallit is a web-based playcalling and playbook-management tool for offensive coordinators and other coaches. We may add, change, or remove features over time. We aim for high availability but do not guarantee the service will be uninterrupted or error-free.
3. Accounts
You must provide accurate information when creating an account and are responsible for keeping your login credentials secure and for all activity under your account. You must be at least 18 years old, or the age of majority where you live, to create an account and purchase a subscription. Notify us promptly of any unauthorized use.
4. Free trial
New accounts receive a 7-day free trial with no credit card required. At the end of the trial, you must subscribe to continue using the paid features. We may change the length or terms of the trial for future users, but changes will not shorten a trial already in progress.
5. Subscription and billing
After the trial, Kallit costs $19 per month (USD), billed monthly in advance through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. Prices may change; we will give reasonable notice before any price change affecting you, and continued use after a change means you accept the new price.
6. Cancellation and refunds
You can cancel anytime from your billing settings. When you cancel, your subscription remains active through the end of the current billing month, and you will not be charged again. We do not provide refunds for the current or past billing periods, including partial months. The 7-day free trial is provided so you can evaluate Kallit before paying.
7. Your content is yours
You retain all rights to the playbooks, plays, tags, schemes, notes, and other content you create in Kallit ("Your Content"). We claim no ownership of Your Content. You grant us only the limited license needed to store, process, display, and back up Your Content in order to operate the service for you. You can export or delete Your Content, and it remains yours if you leave.
8. Starter library
New accounts include a starter library of generic, football-universal templates and content. This starter material is provided to help you get going; once it is in your account you may keep, rename, edit, or delete it freely. The starter library is provided "as is" as a convenience.
9. Acceptable use
You agree not to: use Kallit for any unlawful purpose; attempt to access other users' accounts or data; reverse-engineer, scrape, or resell the service; upload malicious code; or interfere with the service's operation. We may suspend or terminate accounts that violate these Terms.
10. Our intellectual property
The Kallit software, design, branding, and the "Kallit" name are owned by Monson Development. These Terms do not grant you any rights to our software or brand beyond the right to use the service as intended.
11. Disclaimers
Kallit is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. Kallit is a coaching-productivity tool; we do not guarantee any competitive, athletic, or other outcome from its use.
12. Limitation of liability
To the fullest extent permitted by law, Monson Development will not be liable for any indirect, incidental, special, or consequential damages, or for lost data, profits, or opportunities, arising from your use of Kallit. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.
13. Termination
You may stop using Kallit and cancel at any time. We may suspend or terminate your access if you violate these Terms or fail to pay. On termination, your right to use the service ends; you may request an export of Your Content within a reasonable period before deletion.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Arizona.
